The MBC interpretation is expansive — the standard is not "objectively false" but "likely to mislead a reasonable patient". Superlative claims (best, top-rated, leading) that are not substantiated by an objective third-party measurement fall on the wrong side of the standard. Testimonials from actual patients are permitted but the testimonial must reflect that patient's genuine experience, cannot represent atypical results as typical, and any material connection between the patient and the practice (financial or otherwise) must be disclosed. Before-and-after imagery is permitted with patient authorisation and must be representative rather than cherry-picked. Board-certification claims must reflect actual certification and the certifying board must be disclosed.
Business and Professions Code §650 restricts fee-splitting and rebates. The California interpretation reaches per-lead agency compensation models that would be unremarkable in most other states. A pure pay-per-qualified-lead structure where the fee moves with the patient conversion volume creates §650 exposure the MBC has enforced.
