NMC 2026 update 1: Digital content explicitly included The prior Code's vague reference to "advertising" has been clarified: Instagram posts, Reels, Stories, and captions by registered medical practitioners are advertising under Section 6 if they primarily serve to promote the practice or solicit patients. The educational carve-out (content serving patient literacy) remains — and is explicitly formalised.
NMC 2026 update 2: Influencer-marketing provision Any Instagram Reel or post produced by a registered medical practitioner for a third-party brand (supplement, wellness product, health tech app) for commercial consideration is advertising under Section 6 — regardless of ASCI disclosure. This means the content itself must meet Section 6 standards, not just carry an ASCI "#Ad" disclosure.
NMC 2026 update 3: Testimonial consent framework Patient testimonial content on Instagram (journey testimonials, patient experience Reels) now requires documented DPDP-compliant consent specifying: the specific content being used, the platforms (Instagram specifically must be named), the duration, and the right of withdrawal. Before-and-after compliance: 2026 standard
The 2026 NMC revision clarified the identifiability standard for before-and-after imagery. The standard is now explicit:
A patient is identifiable in before-and-after imagery if: (a) their face is visible, (b) unique physical characteristics enable recognition even without the face, or (c) contextual details (unusual presentation, procedure combination, stated location) make identification likely even without a name.
ICG's 2026-compliant before-and-after alternatives:
Option 1 — Patient journey testimonial: Patient narrates their experience on camera in their own words. Face visible. DPDP 2026 consent collected (platform: Instagram specifically named). Journey format ("what my experience was like" — not "before I had X, after I have Y"). Outcome language: "I feel much more confident about my skin now" — subjective experience, not outcome guarantee.
Option 2 — Statistical outcome ranges from published research: "Published dermatology literature shows that most patients completing a 4-6 session fractional CO2 series see measurable improvement in skin texture — individual results vary by skin type, protocol adherence, and baseline condition."
Option 3 — Third-party review embed: Google review or Practo review produced by the patient independently. The clinic does not produce it — outside Section 6's scope. Story Highlights of genuine third-party reviews are NMC compliant.
DPDP Act 2023 testimonial consent — the updated process

You can withdraw consent at any time by messaging us. We'll never share your clinical details — just your experience in your own words.
Reply YES to proceed, or NO if you prefer not to."
This message: specifies the platforms (required under 2026 NMC testimonial consent framework), provides withdrawal right, and protects clinical confidentiality (DPDP Act 2023). The patient's YES reply is stored in the CRM against the patient record — creating the DPDP audit trail.

Q1: Can a doctor share a patient testimonial that the patient posted themselves on Instagram? Yes — with care. Sharing (reposting) content the patient produced independently is not "advertising" the doctor produced under Section 6. However, sharing it with your own promotional caption ("Look at these amazing results!") adds a promotional framing layer that edges into Section 6 territory. ICG recommends: share patient-produced content with an educational or informational caption that does not make outcome claims.
